Legal Question in Family Law in Texas

My husband and I are thinking about divorce. I do not yet have a degree or a job, but I am in school right now for that. If we divorce, the only think I can do is move in with my parents 8 hours away. That way I can get a job, have a free babysitter for our son, and finish school and start provideing for him on my own. Can I get in trouble by the court when we do custody for taking him away from his father during this time?

In most cases, the court will give you custody of the children, but will also restrict the area in which you can establish their home - in other words, you can't move that far away with the children.

Ask your husband if he will agree to do without the geographic restriction.

If he won't agree to it, you have to ask the Court to give you custody without this restriction.
