Legal Question in Family Law in Texas

My husband and I are both on the title to our home, but only he is on the mortgage. I learned he has spent all our savings having a long-term affair and I would like to divorce him. He says if I start divorce proceedings, he will stop making mortgage payments and let the property be foreclosed on so that I will have nothing. What are my options regarding the property? I would like to try to keep it.

You need to file a petition for divorce and get the court to schedule a hearing for the entry of temporary orders while the case is pending. You will ask the court to order that he continue to pay the mortgage payments while the case is pending. I am a board certified specialist in the field of family law practicing in the Houston area.
