Legal Question in Family Law in Texas

Do not know where to go

My husband has a 12 y/o daughter that lives in Austin and the mother denies him the right to see her or talk to her. She wants him to relinquish all rights and he refuses to. We do not have the money for lawyers etc. We have an 8 m/o daughter together and would like for them to know each other and get visitation with his daughter. There has not been a custody or child support case over the daughter. Some how the mother received AFDC several times, our guess is that she did not put my husband as the father. His name is on the birth certificate but they were never married. My husband has not been able to see her because he was in prison and has now finished parole. when we talk to the daughter when the mother is not around, the daughter states that she wants to come live with us because the mother's live-in mistreats her. The mother has been in a mental institution in the passed 5 yrs and has warrants out for her arrest in 4 or 5 counties. I am at a loss! What can I do to help him and what can he do to see his child that wants to see him?

You can try a free legal services group.

Call the State Bar of Texas In Austin for a referral.

He can also go to Texas Attorney General and establish paterity. He would then be ordered to pay child support but he would also get visitaiton. They will NOT help him get custody. TEXAS A G only represents the interests of the State of Texas. Their staff is overwhelmed and they will only do limited legal matters. They are free, however.

If it is a difficult case and you want custody, I think you'll need to retain an attorney.

There are many attorneys that offer a free phone consultation or will consult with you for an hour for a flat-rate. You might call around and see if you can at least sit down with someone and discuss your options.
