Legal Question in Family Law in Texas
My husbands divorce was final 2009. He has a disabled daughter who is 28 years old and lives with her mother. He currently pays child support and health insurance. We are presently in a battle to have his daughter put on his health insurance thru his work. The coverage would be alot better with less monthly premium. Her mother initially said yes, but said we would have to go thru the court to have the divorce changed. We hired an attorney, had her served (as she then backed out) then she countersued us and had a discovery done on my husband for all finances dating from 9 months prior to their divorce to present, also a discovery on all our purchases, our home, our credit cards, our bank statements, etc. I was not mentioned in the counter suit, so I declined and would not allow anything with my name attached to be disclosed. I feel that she thinks that since we are married and I now bring an additional cash flow to our family that she is entitled to more. My question is.. if their divorce was final in October 2009 does she have ANY legal right to any of our finances? We still have not been given the purpose of her counter suit. What are our rights in this situation? We blacked out some of our purchases (that were mine) that were ran thru his accounts (such as my wedding ring set & money I had deposited from an account I had) it seems she is hell bent on knowing what these are. She feels she was cheated when their divorce was done, and know she wants more money. Their division of property was 60/40, her being the 60. I understand her attorney is trying to get her to come to some reason and settle this. He has referred to her as a "Hell Bitch" to our attorney and she is nosey and vengeful. One court date has already been postponed due to her not getting "all" of our financial information. Please help me understand this. We have a meeting with my husbands attorney on Monday, but would like to understand more before going into this meeting.
The divorce was done in Williamson County, Texas.
Thank you so much for your assistance. Sheila
