Legal Question in Family Law in Texas

My Husband's emploer offers a PPO policy. His ex-wife insist on using an out-of-network provider for the kids. This is incurring a dedutable and a co-insurance instead of just a standard co-pay.

Do we have a leg to stand on or does if just fall under the uninsured exspenses?
