Legal Question in Family Law in Texas

My husband's ex-wife has custody of his kids. This year she abandoned both of them 6 months apart and they both live with us now. She still sees them off and on. I have talked to him about going and filing for custody of them but he's scared because a) he's afraid she will come take them back and b) that he will lose the case. We still pay her child support on top of it all. What steps do we need to take?

Based on what you have written, the current Texas Family Code lists reasons which justify modificaiton of a prior court order regarding conservatorship.
