Legal Question in Family Law in Texas

My husbands ex-wife is taking him to court over late alimony and child support payments. he has never been over 20 days late on his payments, but he has been late 5 months in a row. is this going to hold up in court. if so, what are they going to do? can we counter her at he same time and try and get the alimony and child support lowered becuase of change in income?

First, I recommend you hire an attorney.

If you want to lower payments, then you need to file a docuement called a MODIFICATION to lower the payments.

A person is not late on c.s. payments until 30 days has lapsed.

Go on-line and print out his payment schedule. You can sign up under the TX A G website to monitor all payments.

Make sure that none of his payments are "missing". They get lost all the time!
