Legal Question in Family Law in Texas

My husbands has joint custody of his 5 y/o daughter. His ex moved to another city over 100 miles away with her husband approximately 4 yrs ago. She has now been separated from her husband for a year and lives with another man with both of her daughters. The mother leaves our daughter with her (still) stepfather more often than the mother has her. We are not comfortable with this situation and the mother refuses to listen to any reason. What can we do?

You can file a motion to change custody (to your husband, that is).

Or you can ask the court to modify the existing order to require the mother to leave the child with someone other than the stepfather when the child isn't in Mom's personal care. You'll have to come up with a good reason for this, though (something more than not being comfortable).
