My husband's lawyer has set a date for us to appear in court regarding our divorce. I couldn't afford legal representation. Will I be able to stand up for my child during court, even though I don't have a lawyer? Will I be able to present evidence showing my ex-husband as being an unfit parent? I have not presented the evidence to his lawyer, but my ex-husband is aware of the evidence.

You probably won't get much time to talk during the hearing. These hearings are not trials so they are very cut and dry and very short. There is not time for the presentation of evidence during a hearing, so whatever Final Decree of Divorce (Court Order) the other attorney presents to the Judge is probably what will be signed that day. If you have not seen it and agreed to it contact the Court Coordiator of the Court where your case is and your husband's attorney and discuss what is happening. At the very least they will reschedule the hearing to give you more time to look over and agree to any Decree of Divorce that is signed by the Judge. However, if there are serious issues or disagreements concerning custody you need to do whatever you can to get yourself an attorney prior to any hearing. Once the Final Decree of Divorce is signed it is a court order and has to be followed. Whatever you do, don't miss any hearings or meetings, call the Court Coordinator and make sure of the date and time of everything. You have a right to that information also even without an attorney.
