Legal Question in Family Law in Texas

Is it illegal for an ex-husband to pick up a precription dropped off by the custodial mother for their children when the insurance is in the custodial parents name? Our boys are both ADHD and when I tried to pick up the precription medicine I found out their dad had gotten it and took it to his house for the weekends he has them. Now my insurance doesn't want to cover what I need to send them to school with. ADHD is also a particular medicine where the doctors are leary about giving out too much at one time. Asking for refills early usually bears no fruit. What would that fall under?
