Illegal Mother threatens to take kids to Mexico

Wife, an illegal resident and mother of my 3 kids. Has taken 2 out of elementary school saying they had a doctor appt. which was false. She did this without my knowledge and threatens to go back to Mexico. What are my rights as a father to protect my kids. Mother might be living with her mother in Houston but they deny she is there, she has abandoned them before to go to Mexico for a few months this same time last year, but I did not allow her to take my kids since she herself was going to illegally go back and forth thru the US borers. And I have school proof that she left us. We are common law married, but she has no legal papers.

If you meet the requirements of a common law marriage, you can file for divorce and seek custody of the children. Or, you can still file a Suit Affecting Parent Child Relationship and seek custody. If these issues are important to you, I advise you to seek the assistance of an attorney in your area.
