Is it illegal for me to obtain my children during my time with them if ex refuses to relinquish them to me and she is not home with them?

If your decree does not state it is your time to have them and your ex won't agree voluntarily to let you have them, then you cannot have them.
Just because she is not home with them you cannot have them, unless you have the "first right of refusal to babysit".

If you don't understand your current court order, I recommend sitting down in person with a family law attorney and going over it. It is probably worth paying for an hour of an attorney's time to make sure that you clearly understand your court order so that you get to see your children as often as possible.
