Illigetimate son

My son found out 4 1/2 years ago that he had a 5 year old son by a former girlfriend. She was bad into drugs when she called me at 12:30am to tell me she had my sons child. He notified lawyers to see what options he had, because she refused to let us have any contact with him. She was separated from her husband when my son dated her, and she told him that her husband didn't know the boy wasn't his. In Nov. she died of a drug overdose so I wonder if my son has any rights. The other mans name is on the birth certificate. CPS has this boy and his brother, but the grandmother is a foster mom and has custody of them. We found out that the dad actually has them right now, but don't know if CPS knows this. My son wants the boy, but doesn't want trouble with druggies. He is a good father to his 2 children and his wife would be a good mother to them all. What can he do? The lawyers 4 1/2 years told him that it would cost $30,000 to fight her, but now she's dead and will it be that expensive and difficult? The boy looks exactly like my son, but of course, no DNA yet. The step dad has known all along, she lied to my son about that too. Can you give us any help what to do? Thank you.

You're still going to have to fight someone - probably the husband and his family. It's still going to cost a bunch of money. Can't get around that. Good Luck.
