Legal Question in Family Law in Texas

incarcerated father's parental rights concerning adoption of their children in

My fiance is incarcerated in the Texas prison system.

He has a daughter from a previous relationship. While

he has been in prison Child Protective Services has

removed the little girl from custody of the biological

mother. They have demanded that he give up all rights

to his little girl so that she may be put up for

adoption by the state. His lawyer states that there

is nothing he can do for him. What can we do to

keep his little girl from being adopted by complete

strangers? This is killing him and he feels hopeless.

Can I do anything to help?

Re: incarcerated father's parental rights concerning adoption of their children

He can oppose the termination of his parental rights, but he would have to do it by representation. He won't be let out of prison for any court appearances. But, his parental rights can be terminated without his consent because he is not providing for the child, and the court would likely find the adoption to be in the child's best interest.
