Income tax / who files?

I am going through a divorce right now we went to court for temporary orders in sept. I dont have an attorney so i'm kind of lost right now we didnt talk about income tax. he left in June 05 we have two kids together so i'm wondering who gets to file since he was here half a year. And after this year who files next year? I dont want to file and get in any trouble with the IRS

I am not a tax lawyer. In the absence of court orders on the subject, then you follow IRS regulations. Since he has been gone, you should be able to file as head of household. IRS regs normally state that the deduction/dependent belongs to the person providing over 51% of the support. In some cases there may be a multiple support declaration. TCL
