Legal Question in Family Law in Texas

How to Increase Child Support

My daughter is a single divorced mother with full custoday of her two minor children. She was divorced in Jan 1999 in Brazoria County and the amount of child support was stated in the decree and was calculated using the guidelines for child support. She believes that her ex-husband's income has significantly increased since Jan 1999, plus he has a side business that also is producing new income.

What is the process of seeking to increase the amount of child support? What happens, what is an estimate of the cost and how long does it take?

Thanks

Re: How to Increase Child Support

Your daugher would need to file a modification. There is a filing fee. He would need to be served with papers.

How long will it take? It can be quick or long depending if the ex-husband is willing to give her information she needs to determine is additional child support can be justified. He will need to produce 2 years tax returns and 2-3 current paystubs.

Have her call me if she has any specific questions.
