Legal Question in Family Law in Texas
incsurance coverage
My ex has taken my daughter to an out of network dentist, and she has set an appointment up for March. I have urged her to take our daughter to an in network dentist and she refuses. If she refuses to go out of network and I still required by law to pay for the dental care?

Re: incsurance coverage
Maybe, it depends upon the wording in your decree, and the circumstances of the dentist issue.
Many decrees have detailed provisions for using out of network drs in a nonemergency situation. There are procedures to follow, and financial results for following or not following the directions.
If your decree is silent, then it is often an issue for the judge to resolve. You may be able to resolve it at mediation instead. She can voice her rationale for using a different dentist, and you can voice your financial concerns of going outside the coverage. Mediation could be a viable alternative that greatly reduces the legal fees involved.
