Legal Question in Family Law in Texas

Individual Credit Card Debt and Divorce

I have my own seperate bank accounts and credit cards. My husband his own bank account and credit cards. Anticipating divorce, he is spending to their limits and is signing up for additional credit cards thinking that he can pass this debt off to me in a divorce. In Texas, can I get stuck with this debt even though the credit cards are not joint accounts?

Re: Individual Credit Card Debt and Divorce

Short answer: probably not

Longer: Depends on what the money was spent for. "necessaries" (and that's a term used by the Supreme Court of Texas) CREATE COMMUNITY DEBT even if contracted in the name of one party.

You are in over your head. Get a local family lawyer.
