Infidelity

If I can prove infidelity without a doubt, does that effect child custody and the divorce. Is there a time limitation to which it would still be valid?

As to the divorce, it could result in a greater division of the community property in your favor. The key word is "could". As disappointing as the adultery is to you, it is not an uncommon situation. Having an affair is not always viewed by the judge the same way you do. As far as child support, it would not likely have any effect. Child support is calculated according to a formula from the Texas Family Code and adultery is not a factor in the equation. Sorry.
