Legal Question in Family Law in Texas

Information about non paternal daughter

I have been with my wife for 4 years and raised our oldest since she was 2 weeks old and supported her since. We are going through a seperation and I want to know if I can gain custody of her. She got up and left with someone else and took just her biological daughter. She left the other 2. we have 3 kids total and I have the youngest 2 but I would like to find out if I can gain custody of my non biological daughter also temporarily until we go through divorce court and child custody court. She has no job he has no job and they live jumping from address to address. I have a job and a stable place to live and also i had her enrolled in school. Plus the guy she is with now according to CPS he cant be around any of my kids including her.If you can provide info or where or what I can do than i really appreciate it. Thank you

Re: Information about non paternal daughter

You certainly do not have any parental rights to the child. You can file a Suit Affecting Parent Child Relationship asserting the facts that you have alleged; e.g. yours is the only home the child has ever known, she has sibling relationship with your children, and her present environment is unsafe. Despite these facts, the relief you are requesting is not automatic. You need a lawyer and be prepared to pay for quality legal services. You should also be prepared for the possibility of an unfavorable outcome.
