insurance check cashed during divorce

8 wks after I filed for divorce, my husband was in the hospital. while in there our house (which I had moved out of) got broken into and he had tools stolen. he filed an insurance claim and the check came ($8057.00) in his name and/or my name. he cashed the check and never told me anything about it. our divorce is still not final. is there any thing i can do to make him split that insurance check with me? he doesnt know that i know about it.

Tell your lawyer. Those tools were community property, and therefore the insurance proceeds were community property.
