Legal Question in Family Law in Texas
intentional unemployment or underemployment
I am going through a very nasty divorce. My husband is a cocaine addict and an alcoholic. He quit going to work and was fired from a job he held for 10 years making a six figure income. How do I prove intentional unemployment? Will it even matter when the judge sets child support?

Re: intentional unemployment or underemployment
You might be able to show that his experience and education indicates an ability to earn a level of income. On the other hand, addiction has been shown to be a compensable disability which would indicate that his abilities have diminished with his addiction. The cost of proving this claim may exceed the present benefits. Check with your attorney. Good Luck
