Legal Question in Family Law in Texas
Interpreting custody arangement
My ex and I divorced with a pretty standard decree. He gets 1, 3, 5 Friday of each month, plus alternating Holidays, and one month during the summer. Our issue we are having is the way my ex interprets the decree. If he gets custody on Friday at 6 p.m. and says he ''can't come'' that weekend, is he then able to show up at noon on Sunday and have our son until 6pm when his ''custody'' ends? As well, for the summer he passed on June, and then at the end of June passed on July. Now on July 12th, he has changed his mind and would like to have our son until August 1st. Is that what the decree means? Or does he forfeit possession when he does not show up within a reasonable time window from when he is supposed to take posession?

Re: Interpreting custody arangement
No, it probably isn't what the decree means, but without reviewing your decree to make sure it doesn't have any non-standard clauses there is no way to be sure. I don't charge for initial consultations. Feel free to call my office if you would like to make an appointment to review your situation. Ask for my legal assistant, Arlene.
