involuntary termination of our son's birthfather

Our son was placed with us for adoption when he was 48 hrs old and is now 15 months old. When he was 3 months old, his birthfather decided he wanted to parent. We have been in court fighting to keep our family together ever since. We have grounds for termination but the burden of "best interest" is heavy due to the requirement of "clear and convincing" evidence. Any suggestions?

Application of a standard of evidence is dependent upon the evidence presented. Is the father such a bad person that he should not be a parent? Are the adoptive parents such wonderful people to support termination of the father's parental rights? These questions have nothing to do with the personalities involved; these are questions that a judge or jury will resolve depending upon the witnesses and evidence presented. The only suggestion is to find evidence to support your position and to negate the position of the father.
