Legal Question in Family Law in Texas

i was involved in an incident of mistaken identity with my girlfriends daughter she was 15 at the time, i came home from a birthday party a bit drunk and saw my girlfriends car in driveway when i walked in she was not in my bedroom and went back down saw what i thought was my girlfriend sleeping on the floor,( my girlfriend was at her sisters and left the car and her kids in my house) i lay by her trying to get her to go upstairs put my leg on her, she turned over and saw her face realized it was her daughter, i quickly moved away and apologized, next morning her daughter told her aunt and the aunt pressed charges against me. anyways i was charged with unlawful restraint, my girlfriend is now fighting a custody battle over a younger daughter of 5 she has with her ex, cps is now asking to interview me tho the investigation is on her, the ex called cps on her. shall i comply or refuse? record conversation? get a lawyer? san antonio, texas.
