Legal Question in Family Law in Texas

Why am I involved?

I was sent an order of name change and a waiver of service for a child that is not legally mine. Paternity has never been proven in court. He carries the name of another man on his birth cert. Why am I being asked to sign these papers, and am I admitting to paternity by signing? Previously the paternity case was dropped by the petitioner. Could this be an easier way to prove it without any custody battles and fights over child support? In this matter I don't think my involvement is needed? Does this sound right? Thank you.

Re: Why am I involved?

You are correct to be suspicious. This does sound like a back-door approach to the situation. First be absolutely certain that the actual pleadings in the case seek nothing more than a name change. Be aware that they will proceed anyway, by posting your notice on the courthouse door. However, I agree that the less involved you are in peripheral proceedings, the better.

Proceed cautiously, and retain local counsel if necessary to monitor the case.
