Legal Question in Family Law in Texas
I'm an Israeli citizen who moved to the USA two years ago. met a girl in Texas and got legally married after 5 months since i came to the states ( i was supposed to leave the USA after 6 months). after two months being married we realized that its not going to work so we broke up and i left to new york. after the separation i was trying in any way to get a divorce from her but she is not willing to cooperate with me. at some point she seemed to agree and she asked me to send her 450 dollars and all the paper work so she can submit the divorce but she didn't do it, all she wanted was the 450$. we got married in el paso TX. we've been separated for a year and a half, we have nothing that connect us but that marriage license.
she is a us citizen I'm an Israeli alien without status or ssn.
she moved to Lubbock TX 8 month ago and i still live in NYC.
i want to get a divorce, she is not cooperating with that.
how can i do it? how can i divorce her! I'm running out of money and ideas....pls help!

In Texas we do lots of illegal alien divorces. The judges just "look" the other way. I assume that NY does a lot of illegal alien divorces too.
If not, then consider Texas, but I don't know Lubbock judges & perhaps they don't like illegal aliens! But, then I don't know if the judge would know you were an illegal alien -- no one verifies Social Security numbers -- the clerks like every space filled in & they tend to get angry if there are any blanks.
I encourage you to get divorced quickly before she becomes pregnant by another man!
If she does, in the State of Texas, you will be considered the "father" of that child since you are married to her & then your divorce becomes expensive & messy! (I have no idea what the State of NY thinks about children born during the marriage by 3rd parties.)
I live in Houston, Texas and I won't go to Lubbock -- so don't call me!
Lubbock is no where near Houston.
You might check the website www.avvo.com for an attorney.
You don't need a board certified TX attorney.
However, you might want to file in NY since Texas requires one of you to appear in court and testify under oath to a series of questions - it only takes a couple of minutes but you would have to fly down here and do the testifying since I doubt that she is going to cooperate. That would be airfare, hotel, etc. Plus you would risk a judge learning that you are illegal - I'm not sure how they would know you were illegal but perhaps she would show up & cause trouble for you.
Since you live in NYC, can't you find a NYC attorney to help you? Then you need a TX process server to serve her here in Texas. We have lots of process servers in TX. In Texas, they can bring flowers and hand her the divorce petition at the same time - that usually gets the woman to open the door!
I'm only licensed to practice law in Texas -- so I have no idea about NY law. You can post on this website or on www.avvo.com if you have any questions about NY law.
It does not matter about El Paso, TX since no one lives there anymore. So don't worry about El Paso, Texas! You either file in Lubbock or NYC since that is where each of you are living. Since she won't cooperate then you can file where you live.
I hope this information is helpful.
I just got back from visiting my 89 yr. old cousin in Israel. I had not been there in 5 years. I was amazed at the road and building construction. Lots of great new restaurants.
