Legal Question in Family Law in Texas

Jjoint Custody of our 13 year oid Grandson

We have joint Custody of our 13 year oid grandson and we have a letter from our attorney not to release our grandson to his Mother because she did not tell us he he needed to go to summer school during our first half of the summer. We could not get him in earlier because the private school he went to was full. So we enrolled him in a 625 dollar private school in another town. We had him everyday except one school day and also with her care, he missed 40 unexcused absentes, because she said he had migrains, but Nick told us he was most the time due to stress and headaches because of all the pressure there. He does not like his step father or his sister. Said he has never met anyone like her and she is mean and will not let him sleep at night. Nick went to our attorney and signed an affedate that he did not want to go back to her house, and wanted us to have primary custody. We have a letter from our attorney that we will not release him to her. Nick told us 3 times before it was getting that he did not want to go back to return him and said, I do not want to back over there and wanted to live with us as primary parents. His grades with us were A's and B's. With her she changed his school- failing. With her he was always sick

Clearly the letter from your attorney does not have status as an order of the court which would be the only thing that will change the custody of the child. I have no idea what a letter from an attorney is worth in your courts, but here it is practically worthless. If you want to change the custody arrangement, you need to file a motion to modify and be prepared to prove everything you have said with evidence and supporting testimony.
