Legal Question in Family Law in Texas
If Im the joint conservator of my children and it states in my divorce decree that on top of my bi-weekly child support Im responsible for providing health insurance for my children. It also states that Im responsible for half of co-pays, prescriptions and deductibles. Now my question is:
Braces are not covered with my dental insurance because they are considered a cosmetic procedure not a medical visit, procedure or emergency. So if I did not agree to the braces before hand should or am I held accountable for the cost of the braces? Nowhere in my decree does it state that cosmetic procedures are my responsibility.

You'll want to take a good look at the specific wording of the order. However:
Generally, braces are considered part of regular dental stuff - not cosmetic. Teeth are coming in crooked, or there's not enough room for the teeth that are coming in, and braces are required. Even though your dental plan may consider braces to be "cosmetic," the courts probably would not.
