Joint Custody Agreement

I would like to ask a question about joint custody. My ex and I were divorced in the Republic of Panama approx. 2 years ago. She now resides in Texas and I am in Puerto Rico (active duty military). In the custody agreement, we agreed that our two children would reside with her and her new husband in Texas and I would get them during summer vacation.

She has verbally agreed (at her insistence) to allow both children to live with me beginning in May 2000.

My concern is "joint physical custody" since she does not (understandably) want to relinquish any legal footing she already has in regards to custody of the children. If I do not have some type of joint custody agreement, the children will not be allowed to travel at government expense when I transfer out of Puerto Rico (not to mention school enrollment).

Is there a relatively painless way for us to have a post-divorce custody agreement that will satisfy both our desires? Is this something that we can do ourselves in writing and file with the local courts? If not, approx. what would such action cost and how long will it take?

Before this question can be answered, you must first determine which court has jurisdiction to hear your case -- a Texas court or the orginal court that heard the divorce. You may be able to bring this action in your current state if that is where you obtained the divorce.
