Joint Custody

My ex and I have joint custody over our two boys. Ages 9 And 12. Evil ex wants to move them almost 300 miles away. Can he do that legally? There are no geographical limitations set out in the divorce decree. Neither of the boys want to move. The twelve year old can decide for him self, can't he?

You will need to file a motion to modify quickly before he moves. You can ask for custody or at least a domicile restriction. See an attorney about doing this. Don't try this on your own.

The twelve year old cannot decide for himelf.

However he can sign a statement stating his preferences. IT IS NOT BINDING ON THE COURT!
