Legal Question in Family Law in Texas

Joint Custody

My ex-husband and I have joint custody of our daughter but I am the legal domicile. I am getting married and plan to move out of state where my new husband already lives. My question is what rights or what process do I have to go through to be able to move our daughter out of state with me?

Re: Joint Custody

The answer to your question depends upon whether you have a domicile restriction in your controlling order, which I will presume that you do. If so, you will either need the written approval of your ex to move or you will need to file a Motion to Modify and seek to have the domicile restriction removed. This is not an uncommon situation and I have handled many cases such as yours. I am a board certified specialist in the field of family law here in the Houston area. PLease contact me directly if you care to further discuss the options available to you.
