Joint custody in seperate counties

I am in custody battle w/ex, whom I was never married. We have joint custody, alternating fridays for one week, w/him paying me child support, temporarily until final hearing. He lives in different county than me & this is hard on our daughter, she is confused & never wants to go w/either of us when we pick her up, this upsets me very badly..she wants to stay in one place. Wl a judge grant joint custody to parents living in seperate counties? My daughter wl be starting school next year, she is only 3. Also, venue was transferred to his county with an agreement by me, but jurisdiction is in my county because i filed first. Wl this hurt my case being out of my county? Do they have the right to pull credit history during discovery? Is credit history a factor in custody battles?? I have only been able to reach my lawyers assistant when I try to call him. All he has told me is that it could go 50/50. Please help, this has been going on for almost a year..my baby is suffering.

Custody battles are very complex and emotionally draining. Communication with your attorney regarding strategy is essential; you and your attorney must be on the same page. Frankly it sounds like you are in a living night mare. Joint custody can work, however, it needs to be with two parents that live close by. Has a social study been done yet? If you are not communicating with your attorney, fire him and find some one else who is knowlegable in your area. I serve central and south Texas.

If you're dissatisfied with your attorneys performance, fire him first thing Monday morning and find an attorney who will talk to you and address this problem.

Living in different counties doesn't necessarily preclude a court from granting joint conservatorship. There are a number of other factors to consider.

If given a choice, I would normally recommend you litigate a custody fight in your county, especially if the counties are not adjacent to each other. Why did you agree to the transfer??

With regard to your attorney, if you are not communicating with your attorney and feel like your questions are not being answered, you should retain a new attorney. I suggest you consult with a local attorney who you feel comfortable with and who practices family law.
