Legal Question in Family Law in Texas
In joint custody, is visitation an option?
My ex has dropped most of his scheduled visitation times; Wednesdays, 1 weekend and now his month for the summer. We have joint custody and the children live with me. I have been told that he can do this, yet, the court papers say he must give me written notice 2 weeks in advance which he never has. He tells me that visitation is a priviledge - not an obligation. That is not what the court papers say. What can I do to see that he adheres to the court papers?

The only remedy you have for failure to abide by an Order of the Court is to seek contempt. Your ex is not very smart to abandon his children this way, and the court might take away his visitation entirely, but I doubt that the Court would force him to exercise visitation.
