Joint Custody/Child Support

My child's mother is the sole managing conservator of our child, but allowed our child to live with me because the child is over 10yo and wanted to, what are the advantages for me to file for joint custody, especially in establishing the primary residence of the child, and in the area of child support (the mother is married, but is unemployed)?

I agree with Mr. Pfister and I would add that you can request child support. Persons without a job are usually presumed to have a job making minimum wage, unless they are disabled. Get a lawyer and act now.

Since the mother has placed the child in your custody and the child wants to live with you, you have a good chance to modify the divorce order to provide for you to have primary custody of the child. I strongly urge you to file while you have custdody rather than wait for the mother to take the child back first then file. Every case turns on its facts so talk to an attorney before you do anything.
