Legal Question in Family Law in Texas

Joint custody/child support

In filing for divorce, if we have joint custody of the child, will either one of us be required to pay child support? If so, who would be given the payments?

Yes, generally one party will still pay child support. The courts will generally award child support to the party who establishes the child's residence. However, if both parents agree to make other arrangements regarding payment of the child's expenses, child support can be eliminated.

Good Luck.

If you live in Harris County, please give me a call at 713-847-6000.

Today is Monday and I'm busy handling all the calls from the week-end. It might take you awhile to get through to me.

In Texas joint custody does NOT mean that one party is not going to pay child support.

Joint Custody is not defined the way most lay people think it is defined.

Good luck!
