can a judge forces single dad to take child

My new son in law found out he has a 2 yr. old baby by an affair he had.This child was born to a drug addicted mother who gave him to Foster parents.The baby has alot of medical problems.The dad claims he is being forced by the Judge to take the child to raise.This guy has no job,no home and has a warrent out for his arrest.Can a Judge order this?I find this hard to believe. I feel the dad is trying to avoid having to pay child support. Thanks,Yvonne

A parent has a superior right to anyone else on the planet to raise their child.

However, I don't think anyone can be "forced" to take custody of the child.

He can be ordered to pay child suppport & help pay for health insurnace for the child.

If he has no job, he will be ordered to pay child support based on minimum wage working 40 hours per week.

If he does not have an attorney, he definately needs one.

Or, perhaps your daughter needs to talk to one to find out about her rights.
