How does a jury decide who gets custody before there are any charges filed?

I'm not sure what you are asking.
Custody of minor children is a civil matter.
"Charges" are generally for criminal matters.
If a person has not been convicted of a crime then normally the judge in a family law case (such as custody) cannot let in anything about the pending litigation in criminal court.
