Legal Question in Family Law in Texas

my kids have lived with their father and step-mom in Savannah,GA for almost 2 years now ( my daughter is 8 years old and my son is 6 years old ) because I let them. They were not taken from me. If I have them in my posession next summer here in Wichita Falls,TX will I be able to start the custody battle and have everything done here where my kids will be or will I still have to get an attorney in GA?

Where did the divorce decree originate? If all subsequent proceedings have come from that court, then it retains continuing jurisdiction of the case and the kids. It is where you will file to Modify the current orders. If the case originated in Texas, but the kids have established residence in GA, GA law MAY allow a court there to register and modify the decree. Usually a foreign court can only register and enforce the foreign decree, but there are often exceptions. You should at least consult with a GA lawyer.
