Legal Question in Family Law in Texas

Late child support and damages caused by delinquency

My ex is always late with child support. I do understand in garnishing wages it is done by payroll. He quit last job, has a new one. Support was due @ first of the month. He has not paid. His constant "late" support payments put me in a bind in that I cannot make my housepayment on time thus I receive a $25 late fee plus bad credit rating and therefore I cannot get my home refinanced. Can I take him to court to enforce on-time-payment of support and/or sue him for damages to me regarding late fees etc.?

Late support remedies

You can have a withholding order issued which can be sent to his employer. The employer will abide by it and make sure payments are sent on time. If he changes jobs, you have the withholding sent to the next employer. You can cite him for contempt for being late on child support.

husband pays, but is late

Going to court on something like this might get you somewhere, but I strongly believe that it would be a complete waste of time and money.
