Legal Question in Family Law in Texas

Is it ok to leave children home alone? I pulled up to pick up my kids from there mothers and all three of my kids were there by themselfs, my childern told me that this is not the first time that they have had to stay home alone. The ages of my kids are 6,7 and 10. I have been constantly runnig into issues with there mother on them not being clean and feed properly and cps has been involved but has yet to do anything. I was very angry about what I saw and was wanting to know if there was anything I can do to keep this from happening. I do not think they are old enough or mature enough to be home alone. Please if you have anything.

Texas statute does not provide guidance as to what is an 'okay' age to leave a child home alone. Generally, the courts look to the age, maturity of the child; length of time alone and circumstances of being alone. Next door neighbor alerted and available? Ten years old - depending on the child, could well be 'on the bubble' and possibly acceptable. Being responsible for a 6 and 7 year old, however, makes it far less acceptable. Combined with your other concerns, a modification of conservatorship could be a viable option. Speak with an attorney in your community. Good luck.
