Legal Question in Family Law in Texas

Need to leave quickly...please help.

My daughter and I are in a verbally and emotionally abusive situation with my spouse. I have little money and no child support (this is not his child). We have a house, credit cards, furniture (charged recently) and 2 vehicles. He has very bad credit so most things are in my name. I need to find a place for me and my child to live and need to know what I will be responsible for financially. He has made threats that he will ''screw'' me over and won't give me a dime because he thinks that is a way to keep me in the home. I am really frightened to stay but need to know that my daughter and I can manage.

Mr. Grissom gave some good advice, but I would like to add that you should not assume that you should leave. See a lawyer IMMEDIATELY. Since the child is with you, there's a strong probability that the court will enter an order giving you exclusive use and possession of the house. This will mean that, along with the protective order, your husband will have to stay away from the house, or else he will be subject to arrest.

As for your child support, you should also contact a lawyer to pursue support from your child's father, or contact the Texas Attorney General's office for assistance. Good luck.

Sounds like you need a protective order. I don't know how they do it in San Antonio, but here, the DA's office will do it for you - no charge and collect attorneys fees from the offender. Check out some women's support groups in Bexar County, you can probably obtain some counseling and support from one or more of these groups.
