Legal Question in Family Law in Texas

My ex is leaving our 4 year old (5 the 22nd of August) son with his girlfriend who has displayed a horrid temper. So bad that my sons daycare has banned her from the premises. My son also says that he is left alone with her 8 year old daughter.

The orders state by my ex�s request, first right of refusal, our son is not to stay with any non-relative.

Do I have a leg to stand on?

He is breaking the orders.

I'm not clear what the first right of refusal means. Do you have to contact each other before leaving the child with a non relative?

Most decrees give parents the right to place the child in the custody of a responsible adult.

Check and see if the girlfriend has a criminal record, particularly for domestic violence.
