legal advice for a mom of three

I want to leave my husband after 14

years and I would like know the

smartest way to begin the process. I

just moved to Texas from California

and want to go back to where my

family could help my kids and me

financially. What are my rights in

doing that?

Depends on how long you have been in Texas. If you have been here less than six months, you may want to get back to CA fast and file for divorce there if CA laws alloss it. Consult an attorney there. If here more than six months, you will need to file here. You can ask the court to allow you to leave. You will have to overcome the presumption that domicile restrictions are preferred in most courts here in Texas. It can be done but is usually a battle.
