legal age to move out

my daughter is 17 and would like to move in with me. her dad has legal custody but she was placed in my aunts home by CPS at 8 due to abuse by her dad but she wants to live with me now can she legally?

I am confused. Didn't CPS take custody at age 8 when she was placed with the aunt? In any event, you should file a modification of the order, and notice the dad, the aunt and CPS. Otherwise she will have to wait until she turns 18 and graduates high school.
