Legal Question in Family Law in Texas

Whats the legal age!

I have 7 yr old twins. I would like to know what the legal age is for them to be able to make the decision on where they would like to live.

As of recently, state law allows a child of ten years or older to designate a parent to live with. However, there choice is not absolute and a court will have the final say. If the children are under 10, then their opinion might be ascertained by the court through a social study or other court ordered study, but will not carry as much as when they are ten and over. There are a number of factors that a court considers when deciding who to award custody with. If you think there is a need to change custody, then consult with a family law attorney.

The legal age for a child to choose which parent

he/she wishes to live with in Texas is 10 (ten).

However, the choice is still subject to the best

interest test conducted by the court.
