legal gaurdianship of grandson

Recently my daughter committed sucide, she was never married, has one child age 12 ( has only seen biological father twice in his entire life) at age 2 and age 8. Since her death, my grandson has lived with me, he does not want to see dad. Father lives in Louisiana, not sure of exact address since no contact in years, therefore, he has not been informed of her passing. It has been 3 months already since she died. Can I have full legal custody or gaurdianship or will I have to sue father for this? He has not paid his child support in years.
