You don't want guardianship which is a probate matter. You WANT custody which is a family law issue.

You must have "standing" to get custody. If you have had the child in your home for over 6 months and neither parent has lived in the home with you, you have "standing" to ask the court for custody.

If you can't find the parents, they will be "served" by publication and attorneys will be appointed to try to locate the parents.

It's a lot easier if everyone agrees, but it can still be done if no one agrees.

If you live in Harris or Ft. Bend counties, give me a call for a price. I can't leave my phone number so visit my website at www.familylaw4u.com

Good luck!
