Legal Question in Family Law in Texas

How much does legal guardianship of a parent cost?

My father in law passed away 4 mos. ago. We had to take legal action to protect him from himself and my sister in law got guardianship through the court in Feb. He died in March and left a will. No other will or contests were made by anyone. When does guardianship end? How long and how much should this cost? My husband is executor of the estate. There is no real estate; only IRA and some stocks in a Fidelity account.

Guardianship terminates when upon the death of the ward (your father). Issues concerning the disposition of the ward's (your father's) estate will then be handled by the exectutor of his estate named in his will, or if there is no will, the administrator of his estate. Depending on what the assets of your father's estate are, you might be able to follow an abbreviated process of probate. If you have any further questions, feel free to contact me at (832)443-7170. Merely to ad to Ms. Shipp's reply, you can probate a small estate if it does not exceed $50,000.00 If more, then the will will have to be probated as an independent administration because an executor was named. If you are in my area, call for more assistance. 1-888-243-0560
