Legal Question in Family Law in Texas

Legal Recourse

Wife had an affair with a very wealthy man for over 2 years. Other than the obvious divorce - is there any legal recourse against the man she had the affair with?

Re: Legal Recourse

Alienation of Affection is the topic of your question.

It is discussed in a recent Missouri Supreme Court Decision.

Tuesday, May 20, 2003

SC85053

Katherine Louise Helsel v. Sivi Noellsch, D.C.

You will find a national summary of states at:

http://www.worldlawdirect.com/article/992/Alienation_of_affection.html

If property changed hands to this gentleman, you may have recourse to regain property, however your spouse is no longer considered to be property. That is the gist of the Missouri case.

Texas Family Code

1.107 Alienation of Affection Not Authorized -

A right of action by one spouse against a third party for alienation of affection is not authorized in this state.
